Welcome to SIPCREW. These Terms of Service ("Terms", "Agreement") govern your use of SIPCREW's Voice over Internet Protocol (VoIP) services, applications, and related products (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
1. Definitions
"Service" refers to the VoIP communication services provided by SIPCREW, including but not limited to voice calls, messaging, and related features.
"User" or "You" refers to any individual or entity that accesses or uses our Services.
"Account" refers to the user account created to access our Services.
"Content" refers to any data, text, audio, video, or other materials transmitted through our Services.
2. Acceptance of Terms
By creating an account, accessing, or using SIPCREW Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. You also agree to comply with all applicable laws and regulations.
If you are using our Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
3. Service Description
SIPCREW provides enterprise-grade VoIP communication services, including:
- Voice calling services over Internet Protocol
- Call routing and management
- Dialer integration and support
- Number provisioning and porting
- Call analytics and reporting
- Technical support and documentation
We reserve the right to modify, suspend, or discontinue any part of our Services at any time with reasonable notice.
4. Account Registration and Security
To use our Services, you must:
- Provide accurate, current, and complete information during registration
- Complete our Know Your Customer (KYC) verification process
- Maintain the security and confidentiality of your account credentials
- Notify us immediately of any unauthorized access or security breach
- Be at least 18 years of age or the age of majority in your jurisdiction
You are responsible for all activities that occur under your account. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.
5. Acceptable Use Policy
You agree NOT to use our Services for any of the following purposes:
- Illegal Activities: Any unlawful, fraudulent, or malicious activity
- Spam/Robocalls: Unsolicited commercial communications, automated dialing, or robocalls without proper consent
- Harassment: Threatening, abusive, or harassing communications
- Impersonation: Falsifying caller ID information or impersonating others
- Security Threats: Hacking, denial of service attacks, or network disruption
- Toll Fraud: Unauthorized call generation or traffic pumping
- Adult Content: Transmission of explicit adult content without proper age verification
- Do Not Call Violations: Calling numbers on Do Not Call registries without authorization
Violation of this policy may result in immediate account suspension or termination without refund.
6. Service Fees and Billing
Pricing: Service fees are based on your selected plan and usage. Current pricing is available on our website and may be updated with 30 days notice.
Billing Cycle: Services are billed monthly in advance unless otherwise agreed. Usage-based charges are billed in arrears.
Payment Terms: Payment is due upon receipt of invoice. Accounts with outstanding balances may be suspended after 10 days.
Taxes: You are responsible for all applicable taxes, duties, and government-imposed fees.
Refunds: Service fees are non-refundable except as required by law or as specified in our refund policy.
7. Service Level and Availability
SIPCREW strives to maintain 99.9% uptime for our Services, excluding scheduled maintenance. However, we do not guarantee uninterrupted service and are not liable for:
- Internet connectivity issues beyond our control
- Third-party carrier network failures
- Force majeure events (natural disasters, acts of terrorism, etc.)
- Scheduled maintenance performed with reasonable notice
- Issues caused by user equipment or configurations
8. Important Notice Regarding Emergency Services
SIPCREW VoIP SERVICES ARE NOT DESIGNED TO SUPPORT TRADITIONAL EMERGENCY CALLING TO 911 OR EMERGENCY SERVICES.
VoIP services differ from traditional telephone services and may have limitations:
- Emergency calls may not function during power or Internet outages
- Location information may not be automatically transmitted to emergency responders
- Emergency services may not be available in all service areas
You must maintain alternative means of accessing emergency services, such as a traditional landline or mobile phone.
9. Data Privacy and Security
Your use of our Services is also governed by our Privacy Policy. We are committed to protecting your data and comply with:
- General Data Protection Regulation (GDPR)
- California Consumer Privacy Act (CCPA)
- Telecommunications Consumer Protection Act (TCPA)
- Other applicable data protection laws
Call recordings and data are retained according to our data retention policy and applicable legal requirements.
10. Intellectual Property Rights
All content, features, and functionality of our Services, including but not limited to software, text, graphics, logos, and trademarks, are owned by SIPCREW and protected by international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use our Services for your business purposes only.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- SIPCREW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM
- WE ARE NOT LIABLE FOR SERVICE INTERRUPTIONS, DATA LOSS, OR SECURITY BREACHES BEYOND OUR REASONABLE CONTROL
Some jurisdictions do not allow the limitation of liability, so these limitations may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless SIPCREW and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:
- Your violation of these Terms
- Your violation of any law or rights of third parties
- Your use or misuse of our Services
- Content you transmit through our Services
13. Termination
By You: You may terminate your account at any time by providing 30 days written notice.
By SIPCREW: We may suspend or terminate your account immediately for:
- Violation of these Terms or Acceptable Use Policy
- Non-payment of fees
- Fraudulent or illegal activity
- Risk to our network or other customers
Upon termination, you remain liable for all charges incurred before termination.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through our Services at least 30 days before they take effect.
Your continued use of our Services after changes take effect constitutes acceptance of the modified Terms.
15. Governing Law and Dispute Resolution
